WAIVER & RELEASE OF LIABILITY
I do hereby acknowledge that I on February 18, 2022, I will voluntarily participate in an event sponsored by Central County Fire Rescue and/or Central County Community Outreach.
Now, therefore, in consideration for my being permitted to participate in the aforementioned event, hosted by Central County Fire Rescue and/or Central County Community Outreach, I voluntarily and knowingly assume the risk for any injuries or damages that may be sustained during the pursuit of my activities or while on any of the properties owned or controlled by Central County Fire & Rescue. I further, with the intention of binding myself, my spouse, my heirs, legal representatives and assigns, do hereby voluntarily and knowingly remise, release, and forever discharge and hold harmless Central County Fire and Rescue and Central County Community Outreach and their officers, members and employees, commissioners, agents, successors, and assignees from actions, suits, damages, claims or judgements that may result from damages or any personal injury which I sustain while participating in this event.
I have read and fully understand the provisions of this release and have voluntarily and knowingly executed said release with the express intention of effecting the extinguishment of claims and liability herein designated. I also understand that it is my responsibility to thoroughly and completely follow instructions given to me, and my participation may be terminated at any time for breach of instructions.
The provisions of this release shall prevail until revoked in writing to me, but in no event shall these provisions extend beyond 11:59pm on the aforementioned date above. I also understand and acknowledge that the event will be conducted in whole or in part on privately owned property. In the event that I, or someone for whom I am responsible, cause damage to any property beyond that which is expected in the normal course of an event of this nature, I agree to defend, indemnify, and hold harmless Central County Fire and Rescue, Central County Community Outreach, and their officers, members and employees, commissioners, agents, successors, and assignees from any and all claims made as a result of the damage. I further agree and understand that this indemnification and hold harmless clause shall survive the above referenced termination clause and shall continue in full force and effect until six months after any applicable statutes of limitations shall have expired.
PHOTO RELEASE: I hereby authorize Central County Fire Rescue and Central County Community Outreach to use, reproduce, distribute, and display any image, photograph, video, and audio recording, or any reproduction of myself and any minor child under my care in connection with external and internal communications for the sole purpose of advancing programs sponsored or hosted by Central County Fire Rescue and/or Central County Community Outreach. This photo release shall remain in effect until otherwise cancelled or revoked by me with written notification to Central County Fire Rescue and/or Central County Community Outreach.
COVID-19: Central County Fire & Rescue and/or Central County Community Outreach cannot prevent you from becoming exposed to, contracting, or spreading COVID-19 while participating in Central County Fire & Rescue and/or Central County Community Outreach’s activities or entering on Central County Fire & Rescue and/or Central County Community Outreach’s premises. It is not possible to prevent against the presence of the disease. Therefore, if you choose to participate in Central County Fire & Rescue and/or Central County Community Outreach’s activities and/or enter onto Central County Fire & Rescue and/or Central County Community Outreach’s premises, you may be exposing yourself to and/or increasing your risk of contracting or spreading COVID-19.
ASSUMPTION OF RISK: I have read and understand the above warning concerning COVID-19. I hereby choose to accept the risk of contracting COVID-19 for myself and/or any minors in my care in order to participate in Central County Fire & Rescue and/or Central County Community Outreach’s activities and enter on Central County Fire & Rescue and/or Central County Community Outreach’s premises. These activities are of such value to me and/or to any minors in my care that I accept the risk of being exposed to, contracting, and/or spreading COVID-19 in order to participate in Central County Fire & Rescue and/or Central County Community Outreach’s activities and enter on Central County Fire & Rescue and/or Central County Community Outreach’s premises in person.
WAIVER OF LAWSUIT/LIABLITY: I hereby forever release and waive my right to bring suit against Central County Fire & Rescue and/or Central County Community Outreach and their officers, directors, members, employees, agents, successors, assigns, or other representatives in connection with exposure, infection, and/or spread of COVID-19 related to participating in Central County Fire & Rescue and/or Central County Community Outreach’s activities and entering on Central County Fire & Rescue and/or Central County Community Outreach’s premises. I understand that this waiver means I give up my right to bring any claims including personal injuries, death, disability, disease, property loss, or any other loss, including but not limited to claims of negligence and give up any claim I may have to seek damages, whether known or unknown, foreseen or unforeseen.
CHOICE OF LAW: I understand and agree that the law of the State of Missouri will apply to this entire contract.
I HAVE CAREFULLY READ AND FULLY UNDERSTAND ALL PROVISIONS OF THIS RELEASE AND FREELY AND KNOWINGLY ASSUME THE RISK AND WAIVE MY RIGHTS CONCERNING LIABILITY AS DESCRIBED ABOVE:
